  Failure to attempt to reschedule doctor's appointment

    Employee alleged that his employer violated FMLA by denying him intermittent leave for doctor's appointment but did not reasonably attempt to reschedule appointment after he was told his absence would leave employer with inadequate staffing. The employee provided no evidence that he contacted doctor about rescheduling and it appeared doctor would have been amenable to rescheduling. The employee continually misled supervisor by claiming he would work on day of appointment when he, in fact, never canceled appointment.
